Spanish Tax Residency Rules: Why Your Friend’s Answer Won’t Be Yours

Spanish tax residency rules

Short answer: your friends’ advice about Spanish tax residency rules makes a nice story, but your own situation is a different thing, and a professional who sees your papers is the only one who can answer it. Say you’re at a rooftop barbecue in Malaga, a burger in one hand, listening to four people give four completely different answers.

That’s Adrian’s Saturday, anyway. He’s a made up consultant from Dublin, three months into his move, and by Sunday he’s more confused than before. This post follows him through a sensible first step, an enquiry to an expat tax advisor Spain residents can reach, using only what the Advisors in Spain site says. No rules from me. The page lists none, and nobody should take a blog as tax advice.

Five People, Five Answers

One guest swears a particular form is compulsory. Another calls that a myth. A third says her accountant told her something different last year. A fourth just shrugs and offers more potato salad. Adrian, who came for the burgers, writes nothing down because he trusts none of it.

That’s normal, honestly. Everyone’s situation has its own dates and its own paperwork, and advice that fits one person can miss another by a mile. The Advisors in Spain form even says regional rules and taxes differ, which adds one more reason not to copy a stranger.

What the Home Page Covers

The home page lists tax advisors for income tax and wealth tax, plus non resident filings, and accountants for tax returns, gestoria and annual filings. Those are topics. It doesn’t set out the Spanish tax residency rules or any tests, and I’d be suspicious of any page that pretends to do it in a menu line.

What it does offer is a way to ask. If you’re not sure which service you need, you describe the situation and the team routes it. Adrian likes that. It means he doesn’t have to know the right word before he writes.

Sunday Morning, Sober and Curious

Sunday, Adrian wakes up with a mild headache and an itch to do something sensible. He opens the Advisors in Spain enquiry form. It asks whether he’s enquiring as an individual or a business. Individual. Then the service list, which includes Spanish tax advice or a tax return and wealth, investment or exit tax planning.

He picks the first, then Andalusia from the region list. Timing: within a month. In the description he types Spanish tax residency rules as the thing he’s confused about, then adds a few blunt lines: moved three months ago, got five different answers at a barbecue, would like one answer from someone qualified. About three minutes. Nothing to sign.

What They Promise

The site says it aims to reply within one business day, and that the team reads each enquiry itself, even if it can’t take the matter on. If two working days pass, Adrian can write in and they chase it the same day. A written quote comes once a specialist understands the work.

No charge for asking. Scope, fees and engagement terms arrive before he decides anything. Adrian, who’s been burned by a vague quote once, reads them carefully. Honestly, so should we all.

Who Does the Work

Fair question. Depending on the service, Advisors in Spain may do the work itself where permitted. It may also coordinate, or introduce an independent professional who works under their own engagement terms. Before professional work starts, Adrian would know who is responsible, the scope, the fees and the terms.

Credentials get checked where they apply, the site says, along with the person’s stated area of practice and regions covered. And whether the person can work in English or Spanish. Adrian’s Spanish is a polite hello. He’s glad the English part gets checked.

A Messy Monday With the Bank

Monday, Adrian’s bank freezes his card for a security check, in Spanish, by text. He’s in a meeting. He misses it. Back at his desk he finds three messages and a small pit in his stomach. The site lists non resident and corporate bank accounts, with KYC handled, and the form has its own option for opening a Spanish bank account.

He adds a line to the enquiry. I’d ask what handled actually means before relying on it, since the page doesn’t explain. Short question, short answer, probably.

Regions, Timing and the Family Group Chat

The form lists regions from Andalusia and Catalonia to the Balearic and Canary Islands, and says regional rules and taxes differ. Adrian’s brother lives in Madrid and his cousin in Girona, and they’d each pick a different box. Same family, different answer, which is rather the point of this whole post.

Timing has its own menu. The options run from urgently, there is a deadline, to still researching, and urgent enquiries get flagged when the case is reviewed. Adrian picked within a month. His brother, feeling dramatic, said he’d have picked urgent.

Who Stands Behind the Name

Advisors in Spain is the Spanish arm of the Advisors in Europe group, with sister sites for places like Portugal, France, Germany and Italy. The home page quotes figures, such as offices in 18 countries, but says they reflect the previous business experience of the group’s leadership.

So treat the numbers as background, not as a record for this office. What counts for Adrian is simpler: a named person, a written scope and a quote he can say no to.

Finding the Right Person to Ask

Expat tax advisor Spain is what Adrian’s neighbour, a retired teacher from Leeds, typed into her own phone when he told her the barbecue story. She laughed. Her own advice, she said, would be to ask someone who sees the paperwork, and to stop collecting opinions like stamps.

He sends a short follow up, asking who would handle his yearly filings. The accountants page lists tax returns, gestoria and annual filings, the tax advisors page lists income tax and wealth tax, and the site doesn’t say which would take him. That’s one for the reply.

Last Thoughts

Five barbecue answers don’t make a plan. Adrian’s plan is one honest message that names the region and the months. The Spanish tax residency rules are for a professional to apply to his dates, and an expat tax advisor Spain residents can ask about is a fine place to start.

FAQs

Where do I find the Spanish tax residency rules on the site?

You won’t. The home page names tax topics but doesn’t set out residency tests. Ask the team how they apply to your situation.

Is there an expat tax advisor Spain visitors can ask?

The tax advisors page lists income tax and wealth tax, plus non resident filings. Use the enquiry form and describe your situation.

Can I ask about banking at the same time?

Yes. The site lists bank accounts in Spain, non resident and corporate, with KYC handled, and the form has a separate option for opening one.

How fast will they reply?

The site aims to reply within one business day. If you hear nothing after two working days, write in and they chase it the same day.

What does it cost to ask?

Nothing. The site says there’s no charge to submit an enquiry, and a written quote comes before any work starts.
